TERMS OF SERVICE (PARETTO HOMES)
Effective date: April 8, 2026

These Terms of Service (“Terms”) govern your access to and use of the Paretto Homes website and your purchase and use of our digital house plans, files, add-ons, and related services (collectively, the “Products” and “Services”). By purchasing, downloading, accessing, or using the Products or Services, you agree to these Terms.

  1. PRODUCTS AND DELIVERY

  • Products are typically delivered digitally (e.g., PDF files, and if purchased, other formats such as CAD).

  • Delivery timing may be immediate or may take additional time depending on the Product (e.g., add-ons, revisions, or custom work).

  • Unless clearly stated, Products are digital only and are not shipped physically.

  1. WHAT WE PROVIDE (AND DO NOT PROVIDE)
    We provide plan documents and, where offered and purchased, add-ons (e.g., site plan, electrical/lighting plan, foundation plan, reverse plan, wall/framing updates, details, renderings, consultations).

Unless explicitly stated on the product page or in writing, we do not provide:

  • Engineering or stamped plans

  • Permit approval guarantees

  • Site-specific design or region-specific compliance modifications

  • Unlimited revisions or customization

  1. LICENSE AND PERMITTED USE (ONE-BUILD LICENSE)
    Unless your order explicitly includes a different license in writing, your purchase grants a limited, non-transferable, non-sublicensable license to:

  • Use the purchased plan set to construct one (1) structure at one (1) project location

  • Print copies reasonably necessary for that one build (permitting, builder/subcontractors)

You may not:

  • Resell, redistribute, share, publish, or transfer the plans/files (in whole or part)

  • Upload plans/files to public sites, forums, file-sharing services, or AI training datasets

  • Remove copyright notices or proprietary markings
    Unauthorized use may result in termination of your license and legal action.

  1. CUSTOMER RESPONSIBILITIES AND DISCLAIMERS
    Building codes and requirements vary by location and change over time. You are responsible for:

  • Verifying local code compliance, zoning, HOA requirements, and permitting needs

  • Obtaining any required professional review (architect/engineer) and any necessary engineering, stamps, energy reports, and region-specific updates
    We do not control construction means/methods, contractor performance, jobsite safety, or material selections.

  1. PRICING, PAYMENT, AND CHARGEBACKS

  • Prices are shown on our website or provided in writing and may change at any time (changes don’t affect already-paid orders).

  • Payment is due at checkout unless otherwise agreed in writing.

  • If you initiate a chargeback without contacting us first, we may suspend delivery/access and/or deny future purchases while we investigate.

  1. REFUNDS (DIGITAL PRODUCTS)
    Because digital products can be downloaded and copied, all sales are final once delivered or made available for download, except where required by law or at our discretion for:

  • Duplicate charges for the same order

  • Accidental purchase of the same plan twice (promptly reported)

  • A documented technical issue preventing access that we cannot resolve

  • Delivery of the wrong file that we cannot correct

  1. COMMUNICATIONS, INCLUDING SMS TEXT MESSAGING
    We may contact you for customer support, project updates, order notifications, and account-related communications. SMS is intended primarily for transactional and conversational purposes, not bulk marketing.

If you opt in to SMS:

  • Message frequency may vary

  • Message and data rates may apply

  • Reply STOP to opt out; reply HELP for assistance

  • Consent is not a condition of purchase
    We do not sell, rent, or share your phone number with third parties for their marketing purposes. For more details, see our Privacy Policy.

  1. PROMOTIONAL USE
    We may display plan images, renderings, and non-identifying project representations for marketing. We will not intentionally publish your private identifying details.

  2. LIMITATION OF LIABILITY
    To the fullest extent permitted by law:

  • We are not liable for indirect, incidental, special, consequential, or punitive damages (including permit denial, delays, cost overruns, or rework).

  • Our total liability for any claim relating to the Products/Services will not exceed the amount you paid for the Product/Service giving rise to the claim.

    1. INDEMNIFICATION
      You agree to defend, indemnify, and hold harmless Paretto Homes from claims, damages, liabilities, and expenses arising from your misuse of the Products/Services, violation of these Terms, or your construction project.

    2. TERMINATION
      We may terminate or suspend your license/access if you violate these Terms. Upon termination, you must stop using and must not distribute the files.

    3. GOVERNING LAW AND VENUE
      These Terms are governed by the laws of the State of Colorado. Any action must be brought in the state courts located in Mesa County, Colorado, or if federal jurisdiction applies, the United States District Court for the District of Colorado.

    4. CHANGES
      We may update these Terms from time to time. The version in effect at the time of your purchase applies to that purchase.
